This Data Privacy Statement (this “Statement”) describes how BASF India Ltd and its affiliates (“BASF”, “we”, “us” or “our”) collect, store, use, update, transfer, share, disclose, or otherwise process and protect (individually or collectively, “process”) the Personal Data of its customers, distributors, suppliers, etc. (“you” or “your”). It also highlights your rights relating to your Personal Data including the mechanism to exercise those rights.
Further, this Statement is issued to all our existing and prospective customers pursuant to the requirements of the Digital Personal Data Protection Act, 2023 and / or applicable Rules / Regulations, as may be made thereunder, from time to time.
In the course of your dealings with BASF India Ltd and / or its affiliate companies i.e., BASF Agricultural Solutions India Ltd, Nunhems India Pvt Ltd, BASF Agricultural Solutions India Pvt Ltd, Noble Seeds Pvt Ltd and other BASF Group Companies (“BASF”), we have collected and/or will collect your Personal Data to enable BASF to enter into, and manage commercial transactions with you and/or provide you other services. BASF views and treats your Personal Data seriously at all times. BASF has therefore developed this Statement that describes how BASF uses or processes your Personal Data.
BASF shall have the right to modify, update or amend the terms of this Statement at any time. By continuing to engage with BASF or by continuing to purchase or use BASF’s products and services following the modifications, updates or amendments to this Statement shall signify your acceptance of such modifications, updates or amendments.
Personal Data
Your Personal Data is information that relates directly or indirectly to you, who is identified or identifiable from that information or from that and other information.
We will process your Personal Data (first name, last name, email address, mobile number, area of interest and bank account information area of agricultural land you are holding, crops and varieties that you cultivate ) to provide you with personalized information on BASF and its affiliates products, events, web seminars, schemes and services we consider relevant for you and to conduct customer surveys via the communication channels you have selected.
In order to determine your professional needs and interests, we combine and analyse the Personal Data that we have collected about you in the course of your relationship with BASF as a customer or user of BASF / Affiliates products and services.
The list of Personal Data stated above is not exhaustive and may include other personal data depending on the nature of dealings or transaction or the service we wish to provide you or you are seeking from us.
Further, we also wish to inform you that in order to prevent misuse of your Personal Data and / or the digital application and ensure secure access, our digital application will also collect a unique device identifier (such as the Android Device ID), which will be solely used for fraud prevention, security, and account integrity purposes.
Collection and Use of Personal Data
During the course of your transactions and dealings with BASF, you may be requested to furnish your Personal Data from time to time. In addition to the Personal Data you provide to BASF directly, BASF may also collect your Personal Data from a variety of sources and combine it with information you have given us to provide and improve BASF’s products and services and/or for any other purposes related to BASF’s business.
The provision of your Personal Data is voluntary. However, if you do not provide, or withdraw your consent for us to use /process, your Personal Data, BASF may not, amongst others, be able to (i) communicate with you; (ii) provide you the products or services you require; or (iii) fulfil our contractual obligations to you.
Please note that notwithstanding the withdrawal of your consent, the Company may still proceed to process your Personal Data in circumstances recognized and permitted by law.

Purposes of Processing
BASF may use your Personal Data to process the necessary transaction in relation to the relevant matter, and for the business activities of BASF, which shall include:

Disclosure to Third Parties/BASF Affiliates
Your Personal Data may be transferred, accessed or disclosed to third parties for the purposes described above. Further, BASF may provide access or disclose your Personal Data to third party providers (including third party provider engaged by its affiliates) that provide services on behalf of BASF such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in BASF’s products and services and conducting customer research or satisfaction surveys.
Further, your Personal Data may be transferred to any company within the BASF Group including BASF Agricultural Solutions India Ltd, Nunhems India Pvt Ltd, BASF Agricultural Solutions Operations Pvt Ltd and such other affiliates, wherever located locally or overseas under conditions of confidentiality and appropriate levels of security safeguards, to the extent permitted by laws. Your consent also applies to the transmission of your personal information – depending on the location of your business – to other BASF companies worldwide.

Please ensure that the Personal Data you provide us is accurate as neither BASF nor any of its directors, officers or employees will be liable for any Personal Data submitted by you that is inaccurate, misleading, incomplete, or not updated.
